Promotion of Access to Information Act (PAIA):
The Promotion of Access to Information Act (PAIA) upholds the public's right to access information as per the Constitution.
POPIA - Protection of Personal Information Act (POPIA):
The purpose of the Protection of Personal Information Act (POPIA) is to promote the protection of personal information of individuals and businesses and to give effect to their right of privacy as provided for in the Constitution.
The POPIA mandates certain rights to a Data Subject in terms of the personal information that a Responsible Party, such as Eris Property Group (Pty) Ltd or any of its subsidiaries, collects and/or process and/or stores of a Data Subject.
A Data Subject has a right to:
- Be notified that personal information about him, her or it is being collected, the purpose for which such personal information is collected and the source from where such personal information is collected;
- Be notified whether or not the supply of the information by the Data Subject is voluntary or mandatory and the consequences of failure to provide the information;
- Establish whether a Responsible Party holds any personal information of that Data Subject;
- Request access to his, her or its personal information as provided for in section 23 of the POPIA;
- Request the correction, destruction or deletion of his, her or its personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;
- Object on reasonable grounds to the processing of his, her or its personal information as provided for in terms of section 11(3)(a) of the POPIA, unless legislation provides for such processing (for example the Financial Intelligence Centre Act, 38 of 2001 (FIC));
- Object to the processing of his, her or its personal information at any time for the purposes of direct marketing in terms of section 11(3)(b) or in terms of section 69 of the POPIA;
- Not to have his, her or its personal information processed for purposes of direct marketing by means of unsolicited electronic communications except as referred to in section if 69(1) of the POPIA;
- To submit a complaint to the Regulator regarding alleged interference with the protection of personal information or submit a complaint to the Regulator in respect of a determination of an adjudicator as provided for in terms of section 74 of the POPIA;
- To institute civil proceedings regarding the alleged interference with the protection of his, her or its personal information as provided for in section 99 of the POPIA; and
- At any time, withdraw his, her or its consent referred to in section 11(1)(a) (where such consent is required), to the processing of personal information as envisaged in section 11(3) of the POPIA, it being recorded that any such withdrawal and/or objection shall be communicated to the Responsible Party in writing. It being recorded that as an Accountable Institution in terms of the FIC Act, the Responsible Party is by law obligated to collect and process personal information before entering into a business relationship.
Should you require access to the personal information that the Responsible Party has, you need to formally request this in writing, using POPIA - Form 1, which is available on our website and submitting the completed POPIA - Form 1 to popi@eris.co.za
Should you object to the processing of your personal information by the Responsible Party, you need to formally lodge this objection in writing, using POPIA - Form 2, which is available on our website and submitting the completed POPIA - Form 2 to popi@eris.co.za.
If you require any corrections to be made to the personal information that is held by the Responsible Party, or deletion of the personal information of the Data Subject that is held by the Responsible Party, you need to formally lodge this request in writing, using POPIA - Form 3, which is available on our website and submitting the completed POPIA - Form 3 to popi@eris.co.za.
If you want to subsequently withdraw your consent for the Responsible Party to process your personal information, you need to formally lodge this request in writing with the Deputy Information Officer by sending said request to popi@eris.co.za.
